This article outlines current safe harbors in the law for healthcare practitioners who work in a disaster setting. It reviews available legal protection in crisis situations with respect to the Emergency Medical Treatment and Labor Act (EMTALA), criminal liability, and licensure.

Terminally ill patients in 10 states plus Washington, D.C. have the right to take prescribed medications to end their lives (medical aid in dying). But otherwise-eligible patients with neuromuscular disabilities (ALS and other illnesses) are excluded if they are physically unable to “self-administer” the medications without assistance. This exclusion is incompatible with disability rights laws that mandate assistance to provide equal access to health care. This contradiction between aid-in-dying laws and disability rights laws can force patients and clinicians into violating (...) one or the other, potentially creating an underclass of patients denied medical care that is available to those with other (less physically disabling) terminal illnesses. The immediacy of this issue is demonstrated by a lawsuit in Federal court filed in August 2021, requesting assistance in self-administration for terminally ill patients with neuromuscular diseases. This paper discusses the background of this conflict, the ethical issues at the heart of the dilemma, and recommends potential remedies. (shrink)

On September 1, 2023, Texas made important revisions to it its decades‐old statute granting legal safe harbor immunity to physicians who withhold or withdraw life‐sustaining treatment over the objection of critically ill patients’ surrogate decision‐makers. However, lawmakers left untouched glaring flaws in a key safeguard for patients—the transfer option. The transfer option is ethically important because, when no hospital is willing to accept the patient in transfer, that fact is taken as strong evidence that the surrogates’ treatment requests fall outside (...) accepted medical practice. But there are serious shortcomings in how the transfer option is carried out in Texas and many other states, which undermines the ethical usefulness of the process. We identify these shortcomings and recommend revisions to state statutes and professional guidelines to overcome them. (shrink)

Pediatric intervention principles help clinicians and health-care institutions determine appropriate responses when parents’ medical decisions place children at risk. Several intervention principles have been proposed and defended in the pediatric ethics literature. These principles may appear to provide conflicting guidance, but much of that conflict is superficial. First, seemingly different pediatric intervention principles sometimes converge on the same guidance. Second, these principles often aim to solve different problems in pediatrics or to operate in different background conditions. The potential for convergence (...) between intervention principles—or at least an absence of conflict between them—matters for both the theory and practice of pediatric ethics. This article builds on the recent work of a diverse group of pediatric ethicists tasked with identifying consensus guidelines for pediatric decision-making. (shrink)

Considerable recent research in neurosciences has dealt with the topic of consciousness, even though there is still disagreement about how to identify and classify conscious states. Recent behavioral work on the topic also exists. We survey recent behavioral and neuroscientific literature with the aims of commenting on strengths and weaknesses of the literature and mapping new directions and recommendations for experimental psychologists. We reconcile this literature with a view of human information processing (Cowan, 1988; Cowan et al., 2024) (...) in which a capacity-limited focus of attention is embedded within the activated portion of long-term memory, with dual bottom-up and top-down control of the focus of attention. None of the many extant theories fully captures what we propose as the organization of conscious thought at cognitive and neural levels. It seems clear that information from various cognitive functions, based on signals from various brain areas, is integrated into a conscious whole. In our new proposal, the integration involves funneling information to a hub or focus of attention neurally centered in the parietal lobes and functionally connected to areas representing the currently attended information. This funneling process (bringing information from diverse sensory and frontal sources to contact a small parietal area where attended information is coordinated and combined) may be the converse of global broadcasting, from other proposals (Baars et al., 2021; Baars & Franklin, 2003; Dehaene & Changeux, 2011). The proposed system incorporates many principles from previous research and theorization and strives toward a resolution of the relation between consciousness and attention. The amygdala is a key brain area regulating responses to stress and emotional stimuli, so improving our understanding of how it is regulated could offer novel strategies for treating disturbances in emotion regulation. As we review here, a growing body of evidence indicates that the gut microbiota may contribute to a range of amygdala-dependent brain functions from pain sensitivity to social behavior, emotion regulation, and therefore, psychiatric health. In addition, it appears that the microbiota is necessary for normal development of (...) the amygdala at both the structural and functional levels. While further investigations are needed to elucidate the exact mechanisms of microbiota-to-amygdala communication, ultimately, this work raises the intriguing possibility that the gut microbiota may become a viable treatment target in disorders associated with amygdala dysregulation, including visceral pain, post-traumatic stress disorder, and beyond. It is with good reason that the name Rutherford is closely linked with the early history of the alpha particle. He discovered them, determined their nature, and from 1909 used them to probe the structure of the atom. From 1898 to 1902 Rutherford construed alpha radiation as a type of non-particulate Röntgen radiation. On his theory of the locomotion of radioactive particles Rutherford proposed that alpha radiation consisted of negatively charged particles. During 1902 he confirmed the particulate nature of alpha (...) radiation but discovered that these alpha particles were positively charged. Although Rutherford suspected from 1903 that these alpha particles were related somehow with helium, the proof required six long years of investigation. By mid-1908 it seemed certain that the alpha particle possessed two units of the elementary charge. Since the e/m ratio had already been determined for alpha particles, this evidence enhanced the suspected connection with helium. However, this gain and loss of charge was still construed as an ionization effect. Since as late as 1908 gaseous ionization was assumed to involve the gain or loss of a single unit of charge, Rutherford's alleged case of doubly ionized alpha particles was presumably an exception. Yet helium was known to be an inert gas and thus hardly a likely candidate for such exceptional ionization behaviour. To establish the connection, therefore, Rutherford resorted to a spectroscopic test. He collected spent alpha particles shot into a thin glass tube and gradually observed the spectrum of helium. Rutherford had thus been correct in his assumption, but a proper explanation was possible only after the confirmation of the nuclear structure of the atom. (shrink)

Among several possibilities for what reality could be like in view of the empirical facts of quantum mechanics, one is provided by theories of spontaneous wave function collapse, the best known of which is the Ghirardi–Rimini–Weber theory. We show mathematically that in GRW theory there are limitations to knowledge, that is, inhabitants of a GRW universe cannot find out all the facts true of their universe. As a specific example, they cannot accurately measure the number of collapses that a given (...) physical system undergoes during a given time interval; in fact, they cannot reliably measure whether one or zero collapses occur. Put differently, in a GRW universe certain meaningful, factual questions are empirically undecidable. We discuss several types of limitations to knowledge and compare them with those in other versions of quantum mechanics, such as Bohmian mechanics. Although death by neurologic criteria is legally recognized throughout the United States, state laws and clinical practice vary concerning three key issues: the medical standards used to determine death by neurologic criteria, management of family objections before determination of death by neurologic criteria, and management of religious objections to declaration of death by neurologic criteria. The American Academy of Neurology and other medical stakeholder organizations involved in the determination of death by neurologic criteria have undertaken concerted action to address variation (...) in clinical practice in order to ensure the integrity of brain death determination. To complement this effort, state policymakers must revise legislation on the use of neurologic criteria to declare death. We review the legal history and current laws regarding neurologic criteria to declare death and offer proposed revisions to the Uniform Determination of Death Act and the rationale for these recommendations. I argue that Metz's undertaking, in seeking a ‘comprehensive basic norm' to underpin African ethics, is similar to Hans Kelsen's postulation of the Grundnorm in his Pure Theory of Law. But African ethics does not need to be underpinned by an approach such as Kelsen's. In my view, Metz's preference for seeking to develop a Grundnorm rests upon a failure to attend carefully to the distinctness of African ethical thinking from Western ethical thinking. This failure is manifest in a spurious (...) distinction between ‘moral anthropology' / ‘cultural studies' and ‘normative theory'. It is also manifest in Metz's failure to attend carefully to the work of Wiredu and Bujo, both of whom present systematic, critical analyses of African ethical thinking while implicitly rejecting the quest for a Grund norm as being unAfrican. Cowan postulates that the capacity of short-term memory is limited to the number of items to which attention can be simultaneously directed. Unfortunately, he endows attention with unexplained properties, such as being able to locate the most recent inputs to short-term memory, so his theory does little more than restate the data.

We provide additional support for Cowan's claim that short term memory (STM) involves a range of 3–5 tokens, on the basis of language correlational analyses. If language is at least partly learned, linguistic dependency structure should reflect properties of the cognitive components mediating learning; one such component is STM. In this view, the range over which statistical regularity extends in ordinary text would be suggestive of STM span. Our analyses of eight languages are consistent with STM span being about (...) four chunks. (shrink)

The purpose of the paper is to analyse the translation into English and Korean of the old Polish criminal law terminology used by Adam Mickiewicz in his renown poem entitled “Master Thaddeus, or the Last Foray in Lithuania: A Nobility’s Tale of the Years 1811–1812, in Twelve Books of Verse” Mickiewicz (Pan Tadeusz czyli ostatni zjazd na Litwie. Historia szlachecka z roku 1811 i 1812 we dwunastu księgach wierszem). The research methods used encompass the analysis of parallel texts of (...) the poem. The authors first selected the fragments of the poem containing criminal law terminology. Next analysed two translations into English (Biggs in Master Thaddeus, or the last Forey in Lithuania—by Adam Mickiewicz, an Historical epic poem in XII books, translated from the original by Biggs, with a Preface by W.R. Morfill, M.A. and Notes, by the translator and Edmond Naganowski, Trübner et Comp, London, 1885 and MacKenzie in Adam Mickiewicz. Pan Tadeusz or the Last Foray in Lithuania. A Tale of the Gentry in the Years 1811 and 1812 translated into English verse with Introduction by Kenneth R. Mackenzie, Polska Fundacja Kulturalna, Londyn, 1990) and one into Korean Cheong et al. (『판 타데우시』 [Pan Tadeusz] Hankuk University of Foreign Studies, Seoul, 2005). The findings reveal that the terminology under scrutiny in the majority of cases must be considered obsolete and legal system-bound. Mickiewicz (1834) referred to the laws binding Poles under the Third Lithuanian Statute (Wilno, 1774). Therefore, the translators had to face the challenge of deciphering the appropriate meanings and finding equivalents sufficiently conveying them. (shrink)

In 1951–1952 a selected committee appointed by the US Congress investigated the circumstances of the so-called Katyn Crime. The reasons why the highest US legislative body undertook the issue hale to be sought in the international situation of the day, which was determined by the Korean War.The “Katyn Committee” was called up on September 18, 1951 by the House of Representatives of the 82nd Congress on the strength of Resolution 390. Sitting on it were Daniel L. Flood, Thaddeus M. (...) Machrowicz, George A. Dondero, Foster Furcolo, Alvin K. O’Konski, Timothy P. Sheenan and Ray J. Madden, who was also appointed its chairman. The committee began interrogating witnesses on October 11, 1951 and closed the interrogations on November 14, 1952. Simultaneously, the committee inspected 183 material exhibits pertaining to the Katyn event. In all the committee took down the testimonies of 81 main and about 200 secondary witnesses as well as about a hundred written testimonies and accounts.The committee’s final report to the House of Representatives clearly stated the responsibility of the Soviet NKVD for the 1940 massacre of around 15,000 Polish officers from POW camps in Kozielsk, Starobielsk and Ostaszków.In response to the committee’s proceedings the east bloc staged a propaganda campaign aimed at discrediting its work and upholding the so-called Katyn Lie—a 1943—originated false version of the events whereby the executions of the Polish officers had been carried out by the Germans in the latter half of 1941.The Soviet government took an official stand on the committee on February 29, 1952. It rejected all possibility of cooperation and underscored the Germans’ responsibility for the massacre. On March 1, 1952 the Polish government issued a statement condemning the committee and reiterating the false version of the Katyn incident. This statement appeared in the March 1 edition of the national daily Trybuna Ludu under the heading, The Polish nation indignantly condemns the cynical provocations of American imperialists, who are feeding on the tragic deaths of thousands of Polish citizens in Katyn.The main wave of attacks on the Madden Committee rolled through the Eastern European press in March, 1952. It was most intense in the Soviet Union and Poland, but also penetrated to other countries like Czechoslovakia and Bulgaria. In the USSR most of the related coverage was published in the communist party daily Pravda. In Poland articles attacking the Madden Committee and propagating the false version of the Katyn events appeared in all dailies and periodicals, including the party, military, youth, branch and satirical press. Especially avid in this respect were papers brought out by the Czytelnik publishers, notably Życie Warszawy. Also published was a deceitful book The Truth About Katyn by Boleslaw Wójcicki.Simultaneously to the press campaign against the Madden Committee the eastern countries launched broad scale repressions involving the prosecution, courts and intelligence services. The M → W thesis that a meaningful life must be a worthwhile life follows from an appealing approach to the axiology of life. Yet one of the most prominent voices in the recent philosophy of life literature, Thaddeus Metz, has raised multiple objections to that thesis. With a view to preserving the appeal of the axiological approach from which it follows, I here defend the M → W thesis from Metz’s objections. My defense yields some interesting insights about (...) both a meaningful life and a worthwhile life: a meaningful life should be firmly distinguished from a life with meaning, the value of a meaningful life must outweigh whatever disvalue the life has, a worthwhile life at a given time needn’t be a life worth continuing at that time, and the M → W thesis doesn’t preclude the possibility of something being part of what constitutes the meaningfulness of a life without also being part of what constitutes the worthwhileness of the life. This review article offers a discussion of some aspects of the historical and conceptual context when the term “ontology” (Lat. ontologia) was first introduced in the scholarly circles of the early 17th century. In particular, Barry Smith's (2022) analysis of the birth of ontology provides a springboard for some further remarks on the author of the work with the first known occurrence of the word “ontologia”, Jacob Lorhard, including an analysis of his relationship with earlier philosophers Petrus Ramus and Clemens (...) This paper presents a new diachronic corpus of the Italian language, i.e., CODIT (COrpus Diacronico dell’ITaliano ‘Diachronic corpus of Italian’). After a description of the corpus design, the second part of the article is devoted to show possible applications of the corpus in the morphological field, specifically in the domain of evaluative morphology. We highlight the corpus’ strengths and limitations through the diachronic analysis of two affixes, i.e., sopra- and -oide. The study contributes to shed light on the dynamism of (...) evaluative morphology by focusing on the loss of the intensification function suffered by sopra- and the emergence of an approximating value that currently affects -oide. M. F. Burnyeat taught for 14 years in the Philosophy Department of University College London, then for 18 years in the Classics Faculty at Cambridge, 12 of them as the Laurence Professor of Ancient Philosophy, before migrating to Oxford in 1996 to become a Senior Research Fellow in Philosophy at All Souls College. The studies, articles and reviews collected in these two volumes of Explorations in Ancient and Modern Philosophy were all written, and all but two published, before that decisive (...) change. Whether designed for a scholarly audience or for a wider public, they range from the Presocratics to Augustine, from Descartes and Bishop Berkeley to Wittgenstein and G. E. Moore. Their subject-matter falls under four main headings: 'Logic and Dialectic' and 'Scepticism Ancient and Modern', which make up the first volume, with 'Knowledge' and 'Philosophy and the Good Life' contained in this, the second volume. The title 'Explorations' well expresses Burnyeat's ability to discover new aspects of familiar texts, new ways of solving old problems. In his hands the history of philosophy becomes itself a philosophical activity. (shrink)
